Privacy Policy

We wrote this Policy to help you understand what information we collect, how we use it, and what choices you have. We’ve tried our best to explain things in a simple and clear way and also provided a separate FAQ section with details. Please read this Policy carefully, and contact us, if you have any questions or comments.

More simply put: Every company has its privacy policy. This is ours.

By using Trayn’s website and services (Trayn.com, the "Site"), you consent to the collection and use of your information as described below. Please read our Privacy Policy carefully and make sure you follow our updates. When you sign up for our Service, you voluntarily give us certain information, including but not limited to your name, e-mail address, information on your sports organization, location, contact details, and other pieces of information. If you are accessing Trayn on your mobile device, you can also choose to provide us with location data.

Our Privacy Policy is designed to inform you, as a user of the Service, about the types of information that Trayn, and some other companies or entities that we may potentially work with, collect in connection with your use of the Service, which includes but is not limited to your User Content (collectively, “Information”). It is also intended to explain the conditions under which Trayn uses and shares that Information and your rights and choices in relation to the collection and use of your Information.

For the avoidance of doubt, we are not responsible for the practices employed by any websites, content or services linked to or from our Service, including the information or substance contained within them. Please remember that when you use a link to go from our Service to another website or service (including, but not limited to, clicking on advertisements, special offers or other events or activities that are not owned or controlled by Trayn), this Privacy Policy does not apply to such other website, content or service, which are subject to their own rules and policies. Further, you understand and agree that we will have no liability and have no control over any third parties that you authorize to have access to your User Content, which will be at your own risk.

Each time you use the Service, the current version of this Privacy Policy will apply. We therefore encourage you to frequently check this page for changes of our Privacy Policy. Your privacy is important to Trayn, so please do not hesitate to contact us if you have any questions about our Privacy Policy.

1. Information Collection and Use

We collect and use the following two categories of Information for a multitude of purposes, including, without limitation, to develop tools for improving individual and team performance (e.g. by publishing reports on trends and usage of Trayn), and to provide a personalized Service to you and other users and to provide and improve the effectiveness of our Service.

1.1. Personally Identifying Information

When you become a registered User of Trayn, we will ask for certain information that can be used to contact or identify you (“Personally Identifying Information”). Personally Identifying information may include, but is not limited to, your name, sports organization, location/place of birth, website and e-mail address. This is how we collect and use your Personally Identifying information:

1.1.1. Registration Information

When you create an account, we will ask for certain information that can be used by your organization and/or its authorized representatives to contact or identify you, such as your name, username, password, and e-mail address.

Users of the Service are under no obligation to provide us with Personally Identifying information of any kind, with the caveat that a user’s refusal to do so may prevent the user from using or accessing certain Service features.

If requested by your organization, its authorized representatives, or individual coaches and athletes, we will delete the data of such coach or athlete, as applicable if such coach or athlete switches teams or gets traded/transferred to another organization.

1.1.2. Additional information

If the Service has such capability, you may provide additional information to personalize your use of our Service, such as but not limited to your location/hometown, sport, years of experience, or level of professionalism.

1.1.3. Customer Service

We use your Personally Identifying information to contact you with Trayn newsletters, promotional information or Service updates that may be of interest to you. We also use your information to respond to any questions or inquiries you may have.

1.2. Personally Non-Identifying information

We also collect other types of Information that you provide as part of the operation, which is Information that cannot reasonably be used to identify or contact an individual user (“Personally Non-Identifying information”). The following describes the types of Personally Non-Identifying information we gather and how we collect and use them:

1.2.1. User Data

When you use our Service as a registered user to store and manage data such as, but not limited to training, performance, tests, schedules, and other pieces of information, this information is stored in a way so that other members of your sports organization may access it. This information is not automatically shared publicly and not indexed by search engines.

If you as a registered user want to make the information stored in the Service available publicly, you will have to explicitly indicate. Only then will this Information be available to entities outside of your sports organization and may be indexed by search engines. After making Information publicly available, it may not be possible to remove any copies of that Information.

As a registered user you can create reusable content (“Reusable Content”), i.e. content that is designed to be referenced by other content and used throughout the Service by you and other users. This includes, but is not limited to, training plans, exercises and drills, and test templates.

You as a registered user can export and delete Reusable Content for which you have appropriate permissions based on the ownership and permission model. The ownership and permission model regulates how you and other users can use, modify, copy, or export your Reusable Content.

The selection of permission and ownership models may change. Changes to these models are communicated to you as a user two months in advance, in order to give you the possibility to withdraw your intellectual property, before changes are implemented. If you do not agree to these changes, you may terminate the service during this period without further incurring charges.

1.2.2. Log Data

When you use our Service, whether as a registered user or not, our servers automatically record certain log file information that your system of choice (e.g. browser, mobile phone) sends to us, including, but not limited to, your Internet protocol (“IP”) address, system type and settings, websites you visited before you visited our Site, the pages of our Service that you visited, date and the time spent on those pages, information searched for on our Service, number of clicks, and other information. As with other Personally Non-Identifying information gathered from the use of our Service, we compile aggregate statistics which we analyze and disclose in order to enable us and our partners to improve your user experience and personalize our Service. An IP address is usually designated based on a specific country, so an IP address can often be used to identify the country from which users are connecting to our Site.

1.2.3. Cookies

When you use our Service, we may use cookies and similar technologies like web beacons, pixels, and local storage to collect information about how you use our Service. A cookie is a string of information that we store on your computer or your mobile device’s hard disk. We use cookies to track the pages that you visited during your Trayn session in order to compile an aggregate statistic of your use. This helps us understand how our users interact with the Service. Cookies can be deleted by users. When we use cookies, we may use “session” cookies (that last until you close your browser) or “persistent” cookies (that last until you or your browser delete them).

We may ask third-parties to provide ads to your device which may use cookies or similar technologies.

1.2.4. Analytics Data

We use third-party analytics tools to help us measure traffic and user trends for our Service. These tools collect information sent by your device to our Service, including, but not limited to, websites you visit, add-ons, and other information that assist us in improving the Service.

1.2.5. Mobile device identifiers

Our mobile software allows users to access and use the Service from their mobile devices such as tablets and mobile phones. We may access, collect, monitor, store or remotely store on your device a device identifier. A device identifier may allow us to fix bugs, provide us with information about how you browse and use the Service and help us provide you with personalized Trayn Content and advertisements.

1.2.6. Metadata

You can add metadata to your User Content. Metadata is usually technical information that can describe when, how and by whom User Content was collected. You can tag your photos (mark keywords or location) or comment or link to other User Content.

1.2.7. Location information

When you use a location-enabled portion of our Service, if any, we may collect and process information about your then current location, such as GPS signals transmitted by your mobile device or sensor data from your mobile device (e.g., ascertaining user’s location based on nearby Wi-Fi access points and cell towers).

2. Using, sharing and disclosure of your information

The Information we collect may be accessible to other people in your organization, such as coaching, medical, scouting or team operations staff, and ownership group. We use the Information we collect to provide, maintain, protect and improve upon our Service, and to also offer tailored content to users – like giving users more relevant search results.

When you contact Trayn, we may keep a record of your communication to help solve any issues you might be facing. We may use your e-mail address to inform you about updates to the Service, Site, or Mobile Software such as letting you know about upcoming changes or improvements, which may include, but are not limited to, changes to the Terms and Conditions of Service and Privacy Policy (this document).

Trayn may process your information on a server located outside the country where you live; notwithstanding the foregoing, this Privacy Policy and any action related thereto will be governed by the substantive laws of the State of California without regard to its conflict of law provisions.

We may share aggregated information and other information that does not include Personally Identifying Information in anonymous form with third parties (including, but not limited to, research institutions, universities, educational associations, hospitals, analytics providers and advertising companies and networks) for scientific research, industry trend analysis, demographic profiling, advertising and other purposes.

We will access, disclose, use or preserve information when required to do so by law, or in response to a subpoena or court order, legal process or other enforceable government request or when Trayn believes in its sole discretion that disclosure is reasonably necessary to protect the property or other rights of Trayn, third parties or the public at large, including, but not limited to, investigation of potential violations of our Terms and Conditions of Service and our Privacy Policy (this document), and to detect, prevent and otherwise address fraud, security, illegal activity or technical issues.

Trayn reserves the right to transfer all information in its possession to a successor organization in the event of a merger, acquisition, or bankruptcy or other sale of all or a portion of Trayn’s assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all information will be subject to this Privacy Policy, or to a new privacy policy if you are given notice of that new privacy policy and are given an opportunity to affirmatively opt-out of it. Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by the successor organization.

3. How we store and protect your information

Your information may be stored and processed in the United States or any other country in which Trayn, a company in the same group of companies as Trayn or service providers maintain facilities.

We use commercially reasonable safeguards to help keep the information collected through the Service secure and take reasonable steps (such as requesting a password unique to the user) to verify your identity before granting you access to your account. However, the user is aware that the Internet is an open information system and that third parties under certain circumstances may intercept and decrypt the entered data. Trayn cannot warrant the security of your information or guarantee that the information you transmit to our Service may not be accessed, disclosed, altered, or destroyed.

Please help us help you by maintaining the secrecy of your unique password and account log-in information, and for controlling access to e-mail accounts associated with your Trayn account.

4. Your choices regarding your information

You can review, change or delete your User Content and your other information at all times by logging in and editing your account settings via the Service.

You can instruct your browser to refuse web cookies before accessing our Site with the understanding that certain features of our Service may not function properly without the aid of web cookies.

Your mobile device may provide you with choices regarding how and whether device identifiers and location data are provided to us, and our Service may not function properly if use or availability of such functions are impaired or disabled.

You may unsubscribe from all e-mail communications from us by clicking the “unsubscribe link” provided in the e-mails, or, if no “unsubscribe link” is available, by responding directly to the sender indicating your intentions. You may also choose your preference for e-mail notifications for when users provide responses to your questions or responses, or when Trayn provides newsletters. You may not, however, opt out of any applicable Service-related communications (e.g., account verification, changes/updates to features of the Service, and technical and security notices).

You may close your account at any time.

5. Children’s information

Trayn is neither intended nor directed to children under 13. Please do not hesitate to contact us if you have knowledge of a minor child that has submitted personal information without the applicable consent of the parent or guardian of such minor child.

6. Privacy Policy Changes

Trayn may, in its sole discretion, change this Privacy Policy from time to time. Any and all changes to our Privacy Policy will be reflected on this page. We may also provide you with additional forms of notice of modifications or updates as appropriate under the circumstances.

Unless Trayn obtains your express consent, any revised Privacy Policy will apply only to information collected at a point in time after the revised Privacy Policy has taken effect, and will not retroactively affect information that has been collected under any previous Privacy Policies. Trayn will keep prior versions of this Privacy Policy available for review by users.
